MAXBIO Pay Terms of Service
These Terms govern your use of MAXBIO Pay at payment.maxbio.link: the dashboard, hosted and embedded checkout pages, order bumps and upsell funnels, subscriptions, carts, coupons, affiliate tools, file delivery, integrations and the related features (the "Service"). They apply to you as a creator — someone who opens an account to sell.
By creating an account you agree to these Terms and to our Acceptable Use & Prohibited Products Policy, Privacy Policy, Refund Policy and Data Processing Addendum. If you sign up for a business, you accept them on its behalf and confirm you are authorised to do so.
1. Who we are
MAXBIO Pay is operated by Craig McIntosh, a sole trader trading as MAXBIO.LINK and MAXBIO Pay ("we", "us", "our"). Our address is 4 Hyndford's Close, 34 High Street, Edinburgh EH1 1TG, Scotland, United Kingdom.

2. What MAXBIO Pay is — and is not
MAXBIO Pay is software that lets you build checkout pages and sell digital products, services, memberships and subscriptions. Payments from your buyers are processed on your own Stripe account (and, if you connect it, your own PayPal account). You are the seller and merchant of record.
We are not a bank, payment processor, money transmitter or marketplace. We never hold or receive your buyers' money, and we do not take a commission on your sales. Payouts, holds, reserves and account reviews are decided by Stripe or PayPal, not by us.
3. Payment processing by Stripe
Payment processing services for creators on MAXBIO Pay are provided by Stripe and are subject to the Stripe Connected Account Agreement, which includes the Stripe Terms of Service (together, the "Stripe Services Agreement"). By connecting a Stripe account through MAXBIO Pay you agree to the Stripe Services Agreement, as Stripe may modify it from time to time.
As a condition of MAXBIO Pay enabling payment processing through Stripe, you agree to provide us with accurate and complete information about you and your business, and you authorise us to share it and transaction information related to your use of the payment processing services provided by Stripe.
If you connect PayPal, PayPal's user agreement and policies apply to those payments. You give us API credentials for your own PayPal account; we store them encrypted and use them only to create and capture your buyers' payments and issue refunds you request.
4. Your account and plan
You must be at least 18 and give accurate information. You are responsible for your login details and for activity on your account.
MAXBIO Pay costs US$49 per month (plus any applicable tax), billed in advance by card through Stripe. New creators get one 30-day free trial; we take a card when the trial starts and charge it when the trial ends unless you cancel first. The plan renews monthly until cancelled. We may change the price on at least 30 days' notice, effective from your next renewal after the notice period.
You can cancel any time from Dashboard → Billing. Access continues until the end of the paid period. Refunds are covered by our Refund Policy.
If your plan lapses, your checkouts stop accepting new orders, but existing buyers keep access to what they bought and you keep access to your data.
5. Your responsibilities as a seller
- You are responsible for your products, descriptions, prices, delivery, customer service, receipts and refunds, and for honouring any guarantee you offer.
- You must give buyers accurate information, your contact details and a clear refund policy, and meet consumer-protection law where your buyers live — including, for UK and EU consumers buying digital content, obtaining their consent to immediate supply before they lose the 14-day cancellation right. Our checkout shows standard wording for this; you are responsible for it being correct for your products.
- You are responsible for charging, collecting and paying any VAT, sales tax or other tax on your sales. We do not calculate or remit tax for you.
- You are responsible for disputes and chargebacks on your sales and any fees Stripe or PayPal charge for them.
- You must only sell things allowed by our Acceptable Use & Prohibited Products Policy and by Stripe's and PayPal's policies.
- Personal data of your buyers belongs to you. You are its controller and must have a lawful basis and a privacy notice for it; we process it for you under our Data Processing Addendum.
6. Upsells, subscriptions and saved cards
One-click upsells charge a buyer's saved card again after their first payment. You must only present upsells clearly, with the price shown, and only charge when the buyer clicks to accept. Subscriptions you sell renew automatically; you must describe the price, billing interval and how to cancel. We provide a self-service page for your subscribers to update their card or cancel.
7. Affiliates, coupons and email tools
You are responsible for your affiliate programme: recruiting affiliates, the commission you promise, and paying them. We track referrals and calculate commissions as a convenience and do not guarantee attribution. Coupons and bundle discounts are applied as you configure them.
If you connect an email-marketing platform or your own email sender (such as Mailflare or an SMTP service), you instruct us to send buyer details or emails to it. You must have permission to email your buyers and must honour unsubscribes. We only add buyers to marketing lists when your rules say so, and by default only when the buyer ticks the marketing box.
8. Files and content
You keep ownership of your products, files and page content. You give us a non-exclusive licence to host, store, copy and deliver them as needed to run the Service and deliver your products to your buyers. You confirm you have the rights to sell what you sell. We do not use your content to train AI models.
Keep your own copies of your files. We store them securely but are not a backup service.
9. Checkout designs and showcase
You may use our checkout designs for your own sales. You must not copy the Service, resell it, or use it to build a competing product.
10. Suspension and termination
We may suspend checkouts or close an account if you break these Terms, if Stripe or PayPal ask us to, if we reasonably suspect fraud, prohibited products or a high dispute rate, or where required by law. Where reasonable we will warn you first. We may keep buyer download links working so buyers still receive what they paid for.
You may close your account at any time. We delete your data as described in our Privacy Policy and Data Processing Addendum; you should export your orders first.
11. Our liability
Nothing in these Terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence or for fraud.
The Service is provided for business use. We are not liable for indirect or consequential loss, or for loss of profit, sales, revenue, data or goodwill, including sales lost because a checkout, integration, Stripe or PayPal was unavailable. Our total liability in any 12-month period is limited to the fees you paid us in that period.
We are not responsible for Stripe, PayPal, your email platforms or other third-party services, or for decisions they make about your account.
12. Indemnity
You will cover our reasonable losses and costs from any third-party claim arising from your products, your sales, your content, your use of buyer data, or your breach of these Terms or the law.
13. Governing law and disputes
These terms are governed by the law of Scotland. The Scottish courts have jurisdiction, except that if you are a consumer living elsewhere in the UK you may bring proceedings in your home courts, and if you are a consumer living outside the UK you keep any protections that the law of your country gives you and cannot be excluded.
Before starting any claim, please contact us at support@maxbio.link so we can try to resolve it informally.
14. Changes
We may update these Terms. We will post the new version here with a new date, and if a change is material we will tell account holders by email or in the dashboard at least 14 days before it takes effect (unless the change is required sooner by law).
15. General
If any part of these Terms is unenforceable, the rest stays in force. Delay in enforcing a right is not a waiver. You may not transfer your account without our consent; we may transfer these Terms to a successor business. These Terms and the policies they refer to are the whole agreement about the Service.
